Terms of Service
These terms govern your use of Encore, a software service provided by Live Let Live, CVR DK38400169, Munksøgård 68, 4000 Roskilde, Denmark (“Encore”, “we”, “us”). By creating an account or using the service you agree to these terms. If you use Encore on behalf of a company, you confirm that you are authorised to bind that company.
1. What Encore is
Encore is a self-service software product. It reads a brand's public website, generates draft social media posts (image and caption), lets a person on your team review them, gives the brand's owner an approval page, keeps a publishing calendar, and schedules approved posts for publication through connected social accounts.
Encore is not an agency and does not provide services. We do not write, design, review, approve or publish content on your behalf, manage social accounts, or guarantee any marketing outcome. Everything published through Encore is chosen and approved by you and your clients.
2. Accounts
You need an account to use Encore. Keep your login details confidential and tell us at once if you believe they have been compromised. You are responsible for everything done under your account and under the accounts of users you create. You must be at least 18 years old and use Encore for business purposes.
3. Subscriptions and payment
Encore is sold as a monthly subscription that includes a number of brands, a monthly number of posts and a number of users; additional brands are billed monthly per brand, and additional posts are sold as one-time packs. Current prices are on the pricing page and exclude VAT; applicable tax is added at checkout.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. When you subscribe, you also accept Paddle's terms as presented at checkout.
Subscriptions renew automatically each month until cancelled. You can cancel at any time from your account or by emailing support@encoreposts.com; cancellation takes effect at the end of the current billing period. Refunds are described in our refund and cancellation policy.
4. Posts, credits and limits
The subscription includes a number of posts per month. A post is counted when it is generated, including new versions generated after a change request. Unused monthly posts expire at the end of the billing period; purchased post packs remain available while your subscription is active. Extra brands are prorated from the day they are added and stop being billed when removed. We may limit generation speed to keep the service stable for everyone.
5. Your content and your clients' content
You keep all rights to the material you provide (brand assets, websites you point us to, text you write). You confirm that you are allowed to use the brands, logos, names and websites you add to Encore, including your clients' brands, and that you have your clients' permission to generate content about them and to connect their social accounts.
Content generated by Encore for your brands is yours to use once generated. Because generated content is produced by machine-learning models, similar or identical output may be produced for others, and we cannot promise that generated content is unique or free of third-party rights. You are responsible for reviewing generated content before it is published, including for accuracy, legality and compliance with the rules of the platforms it is published to.
6. Acceptable use
You must not use Encore to create or publish content that is unlawful, deceptive, defamatory, infringing, hateful, sexually explicit, or that violates the terms of Facebook, Instagram, LinkedIn, Google or any other platform. You must not add brands or accounts you are not authorised to represent, attempt to access other customers' data, resell access without our agreement, or interfere with the service. We may suspend accounts that break these rules.
7. Third-party platforms and connections
Publishing depends on social networks and on the publishing service we integrate with. Social accounts are connected by their owners through a secure authorisation flow and can be disconnected at any time. We are not responsible for changes, outages or policy decisions made by these platforms, and a post may fail to publish for reasons outside our control. We show publishing status in the app so you can act on it.
8. Availability and changes
We aim for the service to be available around the clock, but it is provided “as is” and we do not guarantee uninterrupted operation. We may change, add or remove features, and we may change prices with at least 30 days' notice by email; price changes apply from your next billing period after the notice.
9. Data and privacy
How we handle personal data is described in our privacy policy. Where we process personal data on your behalf (for example, data about your clients), we do so as your processor under a data processing agreement available on request.
10. Liability
To the extent permitted by law, Encore's total liability for any claim arising out of the service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential loss, lost profits, lost data caused by third-party platforms, or for content you or your clients chose to publish. Nothing in these terms limits liability that cannot be limited under Danish law.
11. Termination
You can close your account at any time. We can terminate or suspend an account for breach of these terms, for non-payment, or if we discontinue the service, in which case we give reasonable notice and a pro-rata refund of prepaid, unused time. After termination we delete your account data in line with the retention periods in the privacy policy.
12. Governing law
These terms are governed by Danish law. Disputes are settled by the courts of Copenhagen, Denmark, unless mandatory consumer law gives you the right to another venue.
